1. Acceptance of terms

By creating an account or using dfd.io ("DFD Terminal", "the Service", "we"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Not investment advice

All content on the Service — including dealer positioning analytics, gamma exposure data, AI-generated commentary and explanations, flow analysis, alerts, scores, and any output of the "Gamma AI" assistant — is provided for informational and educational purposes only. It does not constitute investment, financial, legal, or tax advice, and is not a recommendation to buy, sell, or hold any security or derivative. We are not a registered investment adviser, broker-dealer, or fiduciary. Always do your own research and consider consulting a licensed professional.

3. Trading risk

Trading securities, options, and derivatives involves substantial risk of loss and is not suitable for every investor. Options in particular can result in losses exceeding your initial investment. Past performance, backtests, and historical analogs are not indicative of future results. You are solely responsible for your trading decisions and their outcomes.

4. Data accuracy and availability

Market data is sourced from third-party providers and may be delayed, incomplete, or inaccurate. AI-generated analysis can be wrong. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability. We may modify, suspend, or discontinue features at any time.

5. Accounts and acceptable use

• You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account.
• One account per person. Accounts, and the data they access, may not be shared, resold, or redistributed.
• You may not scrape, bulk-export, reverse engineer, or systematically extract data from the Service, nor use it to build a competing data product.
• We may suspend or terminate accounts that violate these terms or abuse the Service.

6. Subscriptions and billing

• Paid plans (Pro monthly, Pro annual, Founding Member) are billed through Stripe. By subscribing you authorize recurring charges at the then-current rate until you cancel.
• You can cancel anytime; access continues through the end of the paid period. Except where required by law, payments are non-refundable.
• Founding Member pricing remains locked only while the subscription stays continuously active.
• We may change prices with notice; changes apply at your next renewal.

7. Intellectual property

The Service, including its software, design, analytics, models, and content, is owned by DFD Terminal and protected by applicable intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use while your account is in good standing.

8. Limitation of liability

To the maximum extent permitted by law, DFD Terminal and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including trading losses, lost profits, or loss of data — arising from or related to your use of the Service. Our total aggregate liability shall not exceed the amounts you paid us in the twelve months preceding the claim.

9. Changes to these terms

We may update these terms from time to time. Material changes will be announced on the Service or by email. Continued use after changes take effect constitutes acceptance.
